[Cialug] hy-vee uses tux for frozen food

Doesn't that sound like HyVee only needs to acknowledge that they  
used tux if someone asks.  Sooooo they would only be in violation if  
someone asked them about using it and they denied or didn't  
acknowledge using it :)
