I don't think that would count as a critical outbreak of oversized
emails. A 38 KB message would take a whopping 6 or 7 seconds to download
over a 56k connection. Any single web page on the internet other than
the main page of google is larger than that.
I don't disagree that sending random large attachments should be thought
twice about but it's not that big of a problem.
